True Patriot Love – Privacy Policy

This Privacy Policy is edited by True Patriot Love Foundation (“True Patriot Love”), and having its registered office at 150 York Street, Suite 1700, Toronto, ON M5H 3S5 (hereafter, the “Data Controller”).

The Data Controller offers a platform to collaborate on initiatives related to Veterans, serving members and their families (hereafter, the “Platform”) to its users which have subscribed on the Platform and as such have a user account (hereafter, the “Users”). The Data Controller uses a solution called “BuddyBoss”, which enables the import and export of user lists and data, the management of content and events, the organization of emailing campaigns and opportunity research and sharing as well as the management of funds and contributions of any kind.

 

In this regard, the Data Controller collects and processes User’s personal information in accordance with the privacy policy. In addition to and without limiting the reasons provided in the privacy policy, the Data Controller may collect, use, or share personal information for other reasons, which will be described to Users upon the collection of the information, unless otherwise permitted or required by law.

 

The Data Controller is particularly aware and sensitive with regards to the respect of its Users privacy and personal information protection. The Data Controller commits to ensure the compliance of the processing it carries out as data controller in accordance with the Data Protection Law. Data Protection Law is the Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5 and applicable provincial private sector privacy legislation.

 

This privacy policy is intended for the Users of the Platform of the Data Controller.

ARTICLE 1. COLLECTED PERSONAL INFORMATION

1.1 When subscribing on the Platform

When subscribing to the Platform, the User is informed that its following personal information is collected for the purpose of creating a user account:

The User is informed that it is not possible to access the Platform without providing the mandatory data strictly necessary to create an account and authenticate the User.

 

1.2 During the use of the Platform

The User may validly publish, at its own initiative, any content on the Platform (“User Content”):

  • Documents

 

The User is aware that when using the Platform, the User may decide to provide sensitive data, for example, data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, concerning sexual orientation, etc. By providing such sensitive data, the User agrees to their processing by the Platform in the conditions set forth in this Privacy Policy.

 

ARTICLE 2. HOW WE USE PERSONAL INFORMATION

 

The Data Controller and its subcontractors may use the personal information the Data Controller and its subcontractors collect for a number of purposes. The basis for the collection of personal information is set out below.

ARTICLE 3. DATA RETENTION PERIOD

The Data Controller informs the User that the personal information related to the User Account is retained only during the length of the User’s subscription on the Platform.

Following the termination of said subscription, the data collected upon the subscription as well as the content published by the User on the Platform shall be deleted after a period of 90 days.

 

ARTICLE 4. DATA STORAGE

We may process, store, and transfer User personal information in and to the United States, which has different privacy laws than in Canada that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to User personal information through the laws of the United States. ARTICLE 5. USERS’ CHOICES AND EXERCISE OF THE USERS’ RIGHTS

5.1. Communication Preferences

Users may opt-out of marketing and advertising email programs by following the unsubscribe links or instructions included in marketing email, however, even if a User opts-out, the Data Controller may continue to contact the User with service and account related information or other non-marketing communications.

 

5.2 Accessing and Correcting Personal Information

The User is duly informed that it disposes at any time a right to access and the correct its personal information that the Data Controller holds about the User. The Data Controller may not accommodate a request to change personal information if the Data Controller believes that doing so would violate any law, legal requirement or rights of another person, or cause the information to be incorrect. When making a lawful access or request for correction or deletion, the Data Controller may require additional information from the User or take other steps to verify the User’s identity and the User’s right to access the personal information the Data Controller holds about the User. This is done to protect the User’s privacy and maintain security. The Data Controller may charge the User a reasonable fee in instances that require a disproportionate effort, but the Data Controller will advise the User of any fee in advance. The Data Controller may decline to process requests where permitted by law.

 

5.3 Withdrawing Consent

Where the User has provided consent to the collection, use, and disclosure of personal information, the User may have the legal right to withdraw consent under certain circumstances. To withdraw consent, if applicable, contact the Data Controller at the email address below. Please note that if the User withdraws consent, the Data Controller may not be able to provide the User with a particular product or service. The Data Controller will explain the impact to the User at the time to help the User with its decision.

 

5.4 General

The User can exercise its rights by sending an email to the following address info@truepatriotlove.com or by mail at the following address 150 York Street, Suite 1700, Toronto, ON M5H 3S5 provided that the User justifies their identity.

In addition, in the event the User considers that its rights have not been respected, the User of which the personal information is collected can lodge a complaint before the applicable privacy commissioner. For any additional information, you can review your rights on the websites of the applicable privacy commissioners.

 

ARTICLE 6. COOKIES

The Data Controller informs the User that Hivebrite, as well as its subcontractors, uses a tracking technology on its terminal such as cookies whenever the User navigates on the Platform. The User may be able to set its browser to refuse all or some browser cookies, or to alert the User when websites set or access cookies. If the User disables or refuses cookies, please note that some parts of the Platform may become inaccessible or not function properly.

 

ARTICLE 7. RECIPIENT AND PERSONS AUTHORIZED TO ACCESS THE USERS’ DATA

Only authorized persons working for the Data Controller can access your personal information. The Data Controller makes its best effort to ensure that these groups of people remain as small as possible and maintain the confidentiality and security of User’s personal information.

 

The Data Controller also uses trusted service providers to carry out a set of operations on his behalf for hosting. The Data Controller can also use service providers in the tech industry, editors of specific tools integrated in the Platform for technical purposes.

The Data Controller only provides service providers with the information they need to perform the service and ask them not to use your personal information for any other purpose. The Data Controller does its best to ensure that all these trusted service providers only process the personal information on our documented instructions and provide sufficient guarantees, in particular in terms of confidentiality, expert knowledge, reliability and resources, to implement technical and organizational measures which will meet the requirements of the applicable legislation, including for the security of processing.

 

The Data Controller may be required to disclose or share your personal information to comply with a legal obligation, or to enforce or apply our terms of use/sale or any other conditions you have accepted; or to protect the rights, safety or property of True Patriot Love, its customers or employees.

ARTICLE 8. CHANGE OF TERMS OF USE

This privacy policy is subject to change from time to time. Any changes will be posted to this page. Use of the Platform after entering into force the new version of this privacy policy will constitute the agreement to the modified privacy policy. If the User disagrees with such modification of the privacy policy, the User may terminate its use of the Platform in accordance with the terms of use of the platform.
